The case of the barber and the boy

A boy was playing football outside a barber's shop. The barber was shaving a man in front of his shop. The boy kicked the ball and hit the barber's hand which sliced the customer's neck. Both the barber and the boy were taken to court. If you were the judge, who would you charge with murder and why?

This isnt really a "murder" it was literally an accident

That's one way to look at it. Because the barber was holding the "murder weapon", though he didn't cut the customer's neck on purpose. On the contrary, the boy's ball hit the murder weapon resulting in the customer's death. However the kid didn't intend to hit the barber's hand. Both people (barber and boy) didn't have the intention to kill the customer. Still though, a person died, and someone needs to be blamed for it.

Well, i may have to go with vanster on this one because its more similar to vehicular homicide and in incidents of vehicular homicide, a person isnt charged if it wasnt intentional. However, since the question states that someone should be charged i would go with charging the barber since he was the one who had the murder weapon as you said.
